At roughly 6:45 PM tonight (03/07/2025) and after hours of heart-wrenching victim impact statements, Judge Ecton handed down his sentence to Amy Weiss with regard to the death of 10-year-old Ollie Stratton.
- Count One- Careless Driving Resulting in Death- 365 days in jail. $1000.00 fine suspended.
- Count Two- Tampering with Physical Evidence- 364 days in jail. $1000.00 fine suspended.
Sentences are to be served concurrently and with the option of work release. - 12 points against the defendant’s driver’s license.
The defendant is likely to appeal the sentencing, which could delay her incarceration by several months.
In December, a jury found Weiss guilty of careless driving, resulting in death, and she pled guilty to tampering with physical evidence. Earlier this year, Weiss resigned from her teaching job at Lesher Middle School, where she taught math and science.
In Colorado, the maximum sentence for careless driving resulting in death is one year in jail and a fine of up to $1,000. This is a class 1 misdemeanor traffic offense. Other penalties include 12 points against a driver’s license and a one-year suspension of the driver’s license. The maximum sentence for tampering with physical evidence of a misdemeanor crime is up to 364 days in jail and up to $1,000 in fines. This is a class 1 misdemeanor.
Weiss struck Ollie as he crossed the street on his bike near his home in Timnath, Colorado, on August 2nd, 2023. He died of his injuries on August 3rd, 2023. It was proven during a jury trial that Weiss had been texting and making phone calls in the minutes and seconds leading up to the crash. She had lied about Ollie’s direction of travel and had deleted text threads from her phone directly after the crash.
